General terms and conditions for Group Bookings via the Central Limburg Tourist Information Office

Article 1 - Group size

The Tourist Information Office acts for groups of 10 persons or more unless otherwise agreed in writing.

Article 2 - Formation of the agreement

2.1. An agreement will be concluded if the organising Tourist Information Office and the customer have gone through the confirmation by telephone or in writing and have entered into an oral or written agreement. The Tourist Information Office then sends the confirmation to the customer for signing and return within seven days.

2.2. The person entering into the agreement for or on behalf of the group (the customer) is jointly and severally liable for all obligations under this agreement.

Article 3 – Payment

3.1. The organising Tourist Information Office must have received payment of the package deal costs no later than five working days before the start of the programme unless otherwise agreed in writing. In the event of late payment the organising Tourist Information Office is entitled to cancel the booked tour. Costs already paid are not refundable; the cancellation provisions set forth in article 6 of these terms and conditions remain in full force.

Article 4 - Package fees

4.1. The published amount includes all items described in a day trip programme. A booking fee will be charged for each booking. If a customer arrives late this may have consequences; some components of the programme may be cancelled.

4.2. The following are not included in the package deal costs:

a. Transport, unless otherwise agreed in writing;

b. the cost of luggage, accident, healthcare and cancellation insurance;

c. any additional costs for extra consumptions and materials used

4.3. The costs referred to under 4.2c are settled by the customer on the actual day with the respective supplier.

4.4. Unless otherwise stated the published prices are per person.

4.5. The published prices are based on the prices and conditions as they were known when the programme was created. The organising Tourist Information Office reserves the right to modify the price before making the booking if price increases by third parties mean this is necessary, including the applicable VAT rules.

Article 5 - Changes by the participants

Changes by the customer to the agreed programme can be arranged if and insofar as this is possible. In addition to the modified invoice, the customer owes a €10 administration fee per group, per change, as far as no higher expenses are shown. Changes to the agreed programme, which are made between booking and the programme, will be invoiced within fourteen days.

Article 6 - Cancellations

6.1. If a booking is cancelled or changed the following amounts will be charged per reservation, unless otherwise agreed.

a. for cancellations more than fourteen days before the commencement date, 50% will be charged

b. for cancellations more than five days before the commencement date, the customer owes 75% of the amount due.

c. for cancellations five days or less before the commencement date, the customer owes 100% of the amount due.

6.2. Cancellations must be made in writing and dated.

6.3. A reduction in the number of participants within a 10% margin can be made up to ten working days prior to departure. After that, the last known group size applies. 

For reduction of the number of participants by more than 10% the cancellation provisions apply. A reduction or increase in the number of participants must be passed on in writing, by fax or e-mail.

Article 7 - Cancellation of the programme/changes

7.1. If the Tourist Information Office decides that the programme will not go ahead or that changes will be made due to circumstances caused exclusively by the business operations of the Tourist Information Office, the Tourist Information Office undertakes to notify the customer immediately.

7.2. In the event of cancellation the Tourist Information Office undertakes to immediately refund the package costs already paid (in whole or in part).

Article 8 - Complaints

Despite all efforts made it is still possible that the customer believes that he has a justified complaint. This complaint must be submitted to the provider of the service and, if possible, on the actual day to the organising Tourist Information Office.

If direct submission of a complaint is not possible, or if the complaint is not resolved satisfactorily, it must be sent in writing within one month with reasons to the organising Tourist Information Office. If the complaint is not resolved satisfactorily, then no later than three months after the end of the tour the customer may submit the complaint to VVV Nederland, Maarsbergseweg 20, 3957 KW Leersum. However, this does not mean that VVV Nederland is bound by the agreement with the organising Tourist Information Office or that it accepts any liability.

Article 9 - General reserve

9.1. The organising Tourist Information Office reserves the right to make changes to the programme and the associated programme components if reasonable grounds exist to do so.

9.2. The organising Tourist Information Office accepts no responsibility for photos, leaflets and other informative material, as far as published by third parties.

Article 10 - Liability

10.1. The organising Tourist Information Office does not accept any liability for damage resulting from death, injury, accident, offence, theft or loss caused to the participants during or as a result of the tour unless this was caused by intent and/or gross negligence on the part of the employees of the organising Tourist Information Office.

10.2. The organising Tourist Information Office accepts no liability for the costs already incurred by the customer as insurance premiums if a day tour cannot go ahead.

10.3. If and to the extent that timely payment is not made, the customer is in default without any notice being required.

10.4. If the customer is in default, he must pay all judicial as well as extrajudicial costs incurred by the collection.
